Court warns couples to maintain peace after dissolving marriage

After dissolving their marriage, the Customary Court sitting in Oshodi-Isolo LG, has warned Mr. Dauda Idowu and his former wife, Mrs. Funke Idowu to maintain peace.
The divorce case filled by the husband against his wife was transferred from Magistrate Family Court 3, Ogba to Oshodi-Isolo Customary Court.
The presiding President of the Customary Court, Mrs. Adebisi Oladitan, had called for the amendment of the case file OCC/05/2020 before ruling on it.
After the file was amended to enable the Customary court dissolve the marriages, the case was heard and judgement passed.
In the file, the husband, (petitioner) had accused his wife of being troublesome, alleging that she fought neighbours and children and was disobedient.
Responding to the allegations, the wife said her husband was not caring as he stopped taking care of her after their wedding.
She denied being troublesome and quarrelsome to the neighbours as she was accused by her husband.
She also told the court that her husband had seized consummating the marriage for the past two years.
She therefore accepted to grant the petitioner’s divorce request but insisted that their three children should be given accommodation and must be taken care of by the petitioner.
Ruling on the case, the court dissolved the marriage on March 18, 2021, pronouncing that both of them henceforth ceased to be husband and wife.
They were told to maintain peace and order and that any violation of the judgement shall be taken in the content of the court and liable to imprisonment.
However, the court stated that any aggrieved party was free to appeal within 30 days statutory period and that the copy of the judgement would be available to the parties on request.
