 Court stops construction work on Alade market Lagos

The Lagos State High Court in Ikeja has ordered the stoppage of construction work at Alade Market, Allen Avenue.

The order is to subsist pending the determination of a suit by Mrs Adenike Isiba-Kasali, Chief Ligali Adebayo Isiba and Mr. Saheed Adogoke Isiba.

Justice Raliat Adebiyi made the order on an interlocutory motion in a suit numbered ID/7894/19.

It was filed for the plaintiffs by Gbenga Ajala of Wiseview Chambers against the Executive Chairman of Messrs Masters Reality International Concepts Ltd.

The court restrained all parties, including the Ikeja Local Government, from further construction or activities on the property on Alade Village Obafemi Awolowo Way, which is the subject matter of the suit.

Moving the application, Ajala said it was supported by a 29-paragraph affidavit deposed to by the head of the Alli Isiba family.

The plaintiffs asked the court to determine whether, given the circumstances of the case, it was not just and equitable that an order of interlocutory injunction be made restraining the defendants from further trespassing on the family land at Alade Village, Ikeja, pending the determination of the suit.

The family said the land is covered by a Deed of Conveyance dated September 23, 1977, and registered as No. 61, Page 61, in Volume 1657 in the Register of Deeds in the Land Registry, Ikeja.

Justice Adebiyi ordered that pending the hearing and determination of the motion on notice for interlocutory injunction, all parties should stop work on the site.
