 Court summons petitioner’s siblings for allegedly assaulting brother’s wife

The President of Oshodi-Isolo Customary Court, Mrs. Adebisi Laditan, has summoned Wasiu and Mariam Titiloye, the petitioner’s siblings for questioning for allegedly assaulting their brother’s wife.

He said their summon was necessary for the court to decide  if it should dissolve the marriage  between Mr. Yakubu Titiloye (petitioner) and his wife, Mrs. Sakirat Titiloye (respondent).

The husband had filed for divorce accusing his wife of  fighting, stubbornness, and unsubmissive attitude, insisting that he was tired of the union and wanted to opt out of the marriage which has produced a two year old boy.

On the other hand, the wife, also alleged the husband’s family of interfering in matters concerning their union which always led to  constant fighting  adding that her husband has not been performing his responsibility as a father to their little son in terms of feeding, schooling and accommodation.

She presented some pictorial evidence which showed that she was beaten by the petitioner’s younger brother (Wasiu) and the voice record of the petitioner’s younger sister (Mariam) while insulting her during their phone conversations.

Both parties agreed that the marriage be dissolved by the court for them to go their separate ways.

Having listened to both parties, Mrs. Laditan ordered that the petitioner should submit the maintenance allowance of the son to the court every week for the respondent to pickup.

She also summoned the petitioner’s siblings (Wasiu and Mariam Titiloye) to be produced before the court on the adjourned date Thursday, March 11, 2021.

She asked the wife to search for school where the son could be enrolled and to bring along some school fees bills for the court and the parties involved to decide on which to be picked.

Ruling on another similar case, the court president, ordered that a divorce case file  OCC/05/2020 of Mr. Dauda Idowu (petitioner) and Mrs. Funke Idowu (respondent) which was transferred from Magistrate Family Court 3, Ogba to Oshodi-Isolo Customary court be amended before hearing could commence.

The case was transferred to Customary court since the jurisdiction of custody and dissolution of marriage falls within its powers..

The president of Oshodi Customary court, Mrs. Adebisi Oladitan, requested for file amendment since out of the remedies presented in the file, the custody of the children had been decided before the transfer.

Against this ruling, she requested for the file to be adjusted to dissolution, being the part that the customary court will handle.

She, however, ordered for the amendment of the file before the next adjourned date, Tuesday, March 16, 2021.

In the petition, the husband had sought to dissolve   the marriage, alleging that his wife fought with the neighbours and beat the children.

The marriage,contracted in the year 2009 under the native law and custom, was blessed with three boys of 12, 9, and 6 years respectively.
