 Divorce Case: Court orders in-laws to apologise to brother’s wife

Oshodi Customary court has ordered Yakubu Titiloye’s siblings (Wasiu Titiloye and Mariam Azeez) to apologise to their brother’s wife to resolve the marital conflict between the husband, Yakubu Titiloye and his wife, Sakirat Titiloye.

Yakubu Titiloye had dragged his wife to the court, seeking dissolution of their marriage which has produced a two years old boy.

The husband had filed for divorce accusing his wife of fighting, stubbornness, and unsubmissive attitude, insisting that he was tired of the union and wanted to opt out of the marriage.

Responding to the accusation, the wife also alleged the husband’s family of interfering in matters concerning their marriage which,she said, always led to constant fighting between her and her husband’s family, adding that her husband has not been performing his responsibility as a father to their little son in terms of feeding, schooling and accommodation.

She accused her husband’s younger brother, Wasiu Titiloye and his younger sister, Mariam Azeez of assaulting her.

She presented some pictorial evidence which showed that she was beaten by the petitioner’s younger brother (Wasiu) and the voice record of the petitioner’s younger sister (Mariam) while insulting her during their phone conversations.

Following the accusation, the  court president, Mrs. Adebisi Oladitan, had summoned the accused husband’s siblings to appear in court for questioning.

During their last sitting on March 11, Mariam Azeez did not deny the fact that she verbally abused the her brother’s wife through a phone conversation that transpired when Mariam heard from her friend that the respondent went to beat up her mother in her house and Mariam claimed that the respondent abused her and she replied back.

On his own, Wasiu Titiloye denied beating the respondent, insisting that he did not at any point in time beat the respondent at the two occasions presented before the court.

He said he was told by his brother (petitioner) never to touch the respondent.

He presented a torn white polo shirt as an evidence that the respondent tore his clothe when she fought him at the canteen and bit him on the finger to the extent that blood was flowing out, adding that he had to take tetanus injection while treating the wound at the hospital.

When the court asked for his treatment receipt as an evidence, Wasiu could not provide it, saying he did not remember to collect it.

The court also noticed that the torn white polo shirt, which he (Wasiu) claimed to wear on the day his finger was bitten had no bit of blood stain.

Based on the fact established, the court therefore ordered that the petitioner’s siblings apologise to the respondent and to enter into hand written agreement with the court never to harass the respondent again.

The court president also asked the petitioner Yakubu Titiloye to provide accommodation for their two year old child before the marriage dissolution as she adjourned the case till Thursday March 25, 2021.
